Laws & Policies

41 CFR Part 102-37 establishes the federal requirements and procedures for donating federal surplus property to eligible state and local governments, public agencies, nonprofit organizations, and other authorized recipients. The regulations govern the federal surplus property donation process, including eligibility, screening and distribution of property, acquisition and payment requirements, transportation and removal of property, and conditions placed on donated property. The rules are intended to ensure that federal surplus property is distributed fairly, used for authorized public or nonprofit purposes, and managed in accordance with federal requirements.

The GSA Federal Surplus Personal Property Donation Program Handbook provides operational guidance for State Agencies for Surplus Property (SASPs), eligible donees, and other parties involved in acquiring and distributing federal surplus property. The directives establish the procedures the U.S. General Services Administration (GSA) uses to implement the federal surplus property donation program and ensure property is distributed and used in accordance with federal law and regulations.

Idaho Code §67-5740, §67-5741, §67-5742, §67-5743, and §67-5744 establish the legal framework for the State of Idaho’s participation in the federal surplus property program. These statutes authorize the State to acquire, administer, and distribute federal surplus property to eligible public agencies and nonprofit organizations. The statutes establish requirements for the administration, use, transfer, and disposal of federal surplus property and ensure that property is handled in accordance with applicable federal and state requirements.

The Idaho State Plan of Operation functions as the state’s GSA-approved operating framework for administering the Federal Surplus Property Program. It establishes how the state will receive, allocate, distribute, and oversee federal surplus property and how it will comply with federal requirements.

Each SASP operates under a State Plan of Operation approved by GSA.
